Coalition response...The only result from this potential lawsuit is the shifting of valuable funds to legal representation and away from the successful Grasslands Drainage Reduction program that is benefiting the San Joaquin River, the environment and waterfowl. The Central Valley Regional Water Quality Control Board and its biologists have already ruled that a program that is reducing runoff to the river should continue. The program covers 100,000 acres and has already reduced selenium runoff by 89% since 1995.

Resurrecting the ghost of Kesterson belies the success of the current program which serves as an example that could be implemented elsewhere. Kesterson Refuge covered 1,200 acres and 240 bird nesting sites were recorded in 1984, an average of one nest per 5 acres. Monitoring of the few potential nesting sites within 6,000 acres of the current program where birds are likely to appear has resulted in only 2 sites detected in 2009, an average of only one nest per 3,000 acres.

Moving this potential lawsuit forward is a waste of money and threatens the proven successes already acknowledge by the water board.
