Coalition response...The Grassland Bypass Project is a successful project for which the regulatory structure was decided long ago, so suing to revisit the form of regulation is non-productive and wasteful.

The Grassland Bypass Project has already received approval from the Regional Water Board and federal EPA under State and federal law to continue its efforts to reduce discharges into the river.

From 1995 to 2010, drainage water from farm fields in the Project area have been reduced by 75% while an 87% reduction for selenium has been achieved. Consequently, downstream stretches of the river are no longer listed as impaired for selenium by water regulators. Region 9 of the Environmental Protection Agency recently labeled the Project a "success story." The result has been a healthy food supply for consumers around the world and thousands of jobs during the harvest season.

This nuisance lawsuit ignores these accomplishments as it attempts to halt water delivery to farmland that is providing the food and fiber that we all need.
